datescapes Inc. (“Company, we, our and the like”) is committed to protecting the privacy of its clients, planners, employees and all individuals who work in conjunction with the Company. We pay attention to guarding the information provided to us during daily transactions.  

Our Privacy Policy may change from time to time at our sole discretion without prior notice to you and may be modified with additional terms which are applicable to you in all capacities through which you use our Platforms. If we make material changes we will notify you by either sending you an email or by posting the changed Privacy Policy. The date of changes will be noted in the last updated section at the top of this Privacy Policy. If you do not agree with our updated Privacy Policy you cannot continue to use this site or any of our services and you should stop accessing our platform(s) which includes this website, any aps or other technology owned and or operated by the Company currently or hereafter invented (“Platforms”). The Company is currently operating in Toronto, Ontario, Canada however by using Platforms you expressly authorize the use of your information in Canada, the United States and all other jurisdictions where the Company operates or may operate in the future. We do not guarantee full use of Platforms and related services outside of the aforementioned jurisdiction at this time. We will use best efforts to not transmit your personal information in jurisdictions where it is prohibited. You should note that laws may change within the jurisdictions in which we operate and the privacy laws and standards where you reside may compel us to share your personal information with authorities and the like. 

  1. Policy Scope and Application

This Policy Applies to all persons and or entities using Platforms to schedule activities, dates, events and the like (“Users”) through and/or with the assistance of an individual with expertise, knowledge and opinions of activities, events and the like in certain geographic locations (“Planners”). If you interact with Platforms as both a User and Planner this Privacy Statement applies to your different interactions and as such you and the like shall refer to you in all capacities. 

  1. Personal Information You Provide to Us
  • The Company does not share customer names, e-mail addresses or personal information other than as required to fulfill your requests, for the purpose of analytics, market research and such other purposes consistent with the Company and our affiliates legitimate business needs.
  • We limit the use of your personal information to the Company personnel who need your information in order to be able to do their jobs. Third parties and Planners are given only the information they may reasonably require in order to fulfill your requests. We act as an intermediary technology to service your transactions and as such may provide information required in order to hold reservations and suggest relevant information to you.
  • When you order services or pay our fees online through our website, you have several payment options including the use of your credit card or other forms of payment. When you make a purchase, we will forward to the credit facility of your choice; the information necessary for you to charge the amount of your purchase in accordance with the terms and conditions of such credit facility.
  • Your information may also need to be shared with third parties including but not limited to financial institutions to facilitate, expedite and perfect payments to you as Planner.
  • If you permit our Platforms to access your contacts and address books on your various devices we may store certain information from your address books to enable, facilitate and perfect social interactions and the like.
  • For greater certainty, the Company may expressly engage and employ third parties and individuals (including but not limited to analytics providers, payment processors, research companies and security providers) to assist in providing our services. The aforementioned companies will be tasked with keeping your information confidential other than for the express tasks they perform.
  • Third party plug-ins and service providers (including financial institutions) may collect information about how you use our platforms. All interactions with third party platforms may be subject to third-party privacy policies. 
  1. Personal Information related to your  Profile and Account
  • Parts of your profile may be displayed publicly throughout our website for reasons including but not limited to marketing purposes and forums if you post information in forums and other communities. Please be responsible with the information that you share, as the Company generally does not remove content from communal areas. Your information and or opinions may remain public after your account is closed. You remain fully liable and responsible for content posted publicly and shared in community areas.
  • Your public profile page may include but is not limited to the following information, your ratings made by Users, regions where you are looking for or able to book dates, your public photo, your response time to Users, comments you’ve made about previous dates, comments made about you as a Planner and other information you share publicly.
  • Your username and corresponding account will be connected to most of your activities on our Platforms.
  • Your information may be shared if there is a complaint or conflict relating to your account or related activities. 
  • If you are both a Planner and a User the information we shall be adjusted accordingly in relation to the information you share publicly in order to perform services and use our platform.
  1. Other Shared Information
  • Your information will be shared as required by law, by our operating agreements or to enforce our terms and policies.
  • If a User or Planner makes a complaint or there is an accident related to services you provided your information may be shared. 
  • Should we deem that you are compromising our platform or doing unlawful acts (including but not limited to fraud and vandalism) in our sole discretion we may share your information with third parties including but not limited to law enforcement agencies. 
  • As previously noted we reserve the right to use and share your information as reasonably required for business purposes.
  • You may be provided with personal information which relates to other Users. You agree to not use this information for any purpose other than those directly related to performing date planning services requested of you through our platform and other purposes reasonably related to the use of Platforms. 
  • You remain fully liable for any use or misuse of information provided to you by the Company.
  • You expressly agree that in the following circumstances we may release your information (including but not limited to information found in your profile) to third parties: to comply with a subpoena, court order, legal process, or other legal requirement; or when we have reason to believe that disclosure of your information is required to comply with a law, prevent physical harm, financial loss, to prevent or take action against illegal activities (including but not limited to fraud, threats to property) or to ensure that our other agreements and policies are being followed.
  1. About Any Other Information You Send Us

Apart from information you may forward to us concerning orders or e-mail subscriptions and or planning we do not wish to receive any information or other materials from you through this website that may be considered to be confidential or proprietary. All information and materials received (other than information concerning order transactions, e-mail subscriptions and cookie-based information) will be considered to be non-confidential, and you will be deemed to have granted to us an irrevocable license to use, copy, display and distribute such information and materials for any purpose whatsoever. We agree not to use your name in connection with such information or materials without your prior consent.

6. About Information We Can Gather Electronically

Cookie technology is widely used on the Internet and we intend to use it with the intent of making your visit more effective and secure. Cookie-based information is not sold or redistributed. Authorized third parties may be used to collect, track and process such information. The information helps us to:

  • determine what site areas you like;
  • offer you special opportunities; 
  • make navigation through our site easier and faster for you by removing unnecessary windows or frames;
  • respond to inquiries;
  • supply requested information; 
  • track orders.

7. Online Payments

We will abide by generally accepted practices to protect your personal information. You acknowledge that information transmitted over the Internet and protected electronically carries inherent risks and as such we cannot guarantee the absolute security of your information. 

To ensure secure transactions, our site uses the Secure Sockets Layer (SSL) protocol, which encrypts any information you send us electronically. With this system, you can enter your credit card number, delivery and billing information safely through the secure server. The encryption process protects the information by scrambling it before it is sent to us from your computer. Other common methods of protecting your information may also be used. 8. Information

If you use our services you agree to this Privacy Policy and our Terms of Use. You expressly agree to privacy terms in all other Company agreements applicable to you and your use of the Company’s platforms.  

We do not control the information which you may choose to share with us. We reserve the right to monitor all information provided to us or transferred via our website or services to ensure it is in accordance with our general principles. We may at our sole discretion delete, remove or otherwise alter information provided to us. For clarity, we cannot ensure the security of information that is provided to us on our website or via emails. As such you indemnify us from all liability in relation to the interception of information provided to us. We may from time to time suggest activities, events, products and services to you. We do not guarantee the suitability of such activities, events, products and services or the accuracy of the information provided to you in relation to the aforementioned. You will not impersonate any other person and you hereby acknowledge that you have the right, title and interest to share all information you provide to us. 

9. Location Based Information

We use location based services on some of our Platforms. You hereby expressly consent to the use of such information provided to us through the use of any platform using location based services and the like. You shall indemnify, hold harmless, release and waive the Company and our affiliates from any and all causes of action, claims, damages and or all liability arising from the use of location based information.

10. Kept Information

While it remains necessary for the Company to keep your information for the purposes set out in this policy we will use our best efforts to guard your information. We will require access to your information while your account is still active and in order to enable Planners to provide you with services. Should you determine that you would like us to no longer provide you with services you may delete your account. After you delete your account or terminate services we also will keep your information to adhere to applicable legal obligations, to enforce various agreements and to resolve disputes. Please note that in deleting your account your email address may not be available to be associated with a new account. Unless permitted in writing you agree to not hold more than one account at a time. 

11. Decisions

You are able to review the information you have provided to us in your account settings. At any time you are able to remove any information listed as optional. You may also determine what types of information you will receive from us in your settings. 

We may send you required information about your services or activities. Required messages may include legal notices however you may choose to opt out of optional messages which may include activities, newsletters and promotions. Should you not desire to receive mandatory service related messages from the Company, you should close your account(s). If you desire to limit certain forms of tracking via cookies you should review your personal internet settings and make the required amendments. Any connections and settings related to third party apps including but not limited to websites like Facebook must be amended on their platforms after permissions have been granted. 

12. Contact

In addition to mandatory notice, we may from time to time email you publicly available information, special opportunities and or products which we believe may be desirable to you. You will have the option to opt out of all such communication. If you have submitted personal information to us electronically and would like to access it, have it removed or modified you may modify such information associated with your account through your account settings page or in the alternative you may contact us.
